A judge has ordered prosecutors to destroy copies of items that were discovered during an unannounced raid on Sean "Diddy" Combs' jail cell.
The ruling came down during an emergency hearing held on Tuesday, November 19, following a request from Combs' lawyers. In a previous filing, attorney Marc Agnifilo accused the prosecution of obtaining "privileged material" from the unlawful raid and using it against his client. The prosecution denied that they maliciously collected 19 pages of notes from Combs' bunk. However, Judge Arun Subramanian sided with the defense and demanded prosecutors to "get rid of" all copies of the notes, per TMZ.
Prior to the hearing, prosecutors tried to defend the pre-planned raid by claiming Combs was trying to influence potential witnesses and jurors by using third party methods to communicate with others. They also accused Combs of coordinating with his children to make social media posts that shined a positive light on him. In response, the defense said they were not warned about the raid in advance and argued the search was a violation of Combs' Fourth, Fifth and Sixth Amendment rights.
Judge Subramanian agreed with the defense. After he made his ruling, the judge clarified that prosecutors shouldn't use the information from the notes until he makes final decision on whether or not said notes can be used at trial. Combs will head to trial on May 5, 2025. He has been denied bail several times and will remain behind bars until the trial begins.
Combs was arrested in September on charges of sex trafficking and racketeering. He pleaded not guilty to the crimes. He also maintained his innocence regarding other allegations named in lawsuits from various alleged victims. See what The Breakfast Club had to say about the situation below.
